Please read these Terms of Use & Privacy Policy before using this website and services offered by, SonicScoop Media, Inc./classifieds.sonicscoop.com (collectively, “CSS”).Also – Please use caution, common sense, and practice safe buying and selling when using CSS.

This Agreement governs the relationship between CSS and you, the Site visitor (parties that simply browse the website without being or becoming a registered user) and/or customers, merchants, and contributors of content (“you”, “your”, “user”, “users”), with respect to your use of the Site. It is important that you read carefully and understand the terms and conditions of this Agreement. By accessing or using the site, you signify that you have read, understand and agree to be bound by this agreement. This Terms of Use of Agreement also includes and hereby incorporates the site’s Privacy Policy. You agree to be bound by both agreements/policies and any other policies which shall be updated and incorporated by reference to this agreement with notice being effective as per the date of publication thereof. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) this site or any of the services offered herein.

This Agreement applies to all users of the Site, including without limitation users who are vendors, customers, merchants, contributors of content, information and other materials or services on the Site.

  1. Modifications to Terms of Use

CSS reserves the right, at our sole discretion, to change, modify, add, or delete portions of these Terms of Use or the Privacy Policy at any time without further notice. Such revisions are effective immediately after we give notice thereof, which we may do by revising the “Date of Last Revision” date of these Terms of Use or by otherwise posting on the Website, or by email or conventional mail, and/or by any other means which provides reasonable notice. Your continued use of the Website after any such changes constitutes your acceptance of the new Terms of Use. This Agreement includes and incorporates the site’s Privacy Policy. It is your responsibility to regularly check the Website to determine if there have been changes to these Terms of Use and to review such changes.

You agree that CSS shall not be liable to you for any delay or other damages that might result from any changes to the Terms of Use, if any. We reserve the right, in our sole discretion, to deny, restrict, suspend, or terminate your access to all or any part of the Website at any time, for any or no reason, with or without prior notice or explanation, and without liability. We expressly reserve the right to remove your profile, sales listing, and/or other information and/or deny, restrict, suspend, or terminate your access to all or any part of the Website if we determine, in our sole discretion, that you have violated this Agreement or pose a threat to the Website and/or its other users. If you do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) this site.

2.SonicScoop Classifieds is a VenueSonicScoop Classifieds/classifieds.SonicScoo.com (“CSS”) acts as a venue to permit users who comply with CSS’s TOU to offer, sell and buy certain goods and services at a fixed-price format. CSS is not directly involved in the transaction between buyers and sellers, and CSS has absolutely no control over and makes no representations regarding the quality, safety, morality or legality of any aspect of the sales items listed, the truth or accuracy of the sales listings, the ability of sellers to sell items, or the ability of buyers to pay for items. CSS does not pre-screen users (except for services which may require an application) or the content or information provided by users. CSS also cannot ensure that a buyer or seller will actually complete a transaction. Further, CSS does not transfer legal ownership of items from the seller to the buyer. CSS cannot guarantee the true identity, age, and nationality of a user. CSS encourages you to communicate directly with potential transaction partners through the tools available on the Site.

As such, you agree that CSS is a venue, and further agree that CSS is not liable for any content, for example, data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links posted by you, other users, or outside parties on CSS. You agree to use the CSS service completely at your own risk.

  1. Eligibility

Use of the Website and registration to become a member of the site is void where prohibited. You must be at least 18 years old or otherwise have the express consent of your parents or legal guardians, but in no event younger than 13 years old, to use the Website. If you do not meet these requirements or, if for any reason, you do not agree with all of the terms and conditions contained in this Agreement, please discontinue using the Site immediately. By agreeing to these terms or by using the Website, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement. The Website may require each User seeking to use its services to complete a profile for validation by the Website. The Website reserves the right to decline its services to any User for any reason and without explanation based upon its findings in validating the User’s profile. CSS cannot prohibit minors from visiting this site and must rely on parents, guardians and those responsible for supervising children under 13 to decide which materials are appropriate for such children to view and/or purchase. Pursuant to 47 U.S.C. Section 230 (d), as amended, we hereby notify you that parental control protections (such as computer hardware, software or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. Information identifying current providers of such protections is available on the two websites GetNetWise (http://kids.getnetwise.org) and OnGuard Online (http://onguardonline.gov). Please note that CSS does not endorse any of the products or services listed at such websites.

You are responsible for all applicable taxes. In addition, some services offered through the Site may be subject to additional terms and conditions promulgated by CSS from time to time; your use of such services is subject to those additional terms and conditions, which are incorporated into this Agreement by this reference.

  1. Access from outside the US

The Site is primarily directed to individuals residing in the United States. We make no representation that services or materials available on or through the Site are appropriate or available for use in other locations. Those who choose to access the Site from other locations do so on their own initiative and at their own risk, and are responsible for compliance with local laws, if and to the extent local laws are applicable. We reserve the right to limit the availability of the Site and/or the provision of any service, program, product, or other offering described thereon to any person, geographic area or jurisdiction, at any time and in our sole discretion, and to limit the quantities of any such service, program, product, or other offering that we provide.

  1. Term of the Agreement

This agreement, and any posted revision to this Agreement, shall remain in full force and effect while you use the Website or are a Member. You may terminate your membership (“Membership”) at any time, for any reason, by following the instructions on the Website. We may terminate your Membership at any time, for any or no reason, with or without prior notice or explanation, and without liability. Upon such termination, you must immediately discontinue use of the Website, and CSS shall in no way be responsible to you for such termination.

SonicScoop Classifieds, classifieds.sonicscoop.com, and other CSS graphics, logos, designs, page headers, button icons, scripts, and service names are trademarks or trade dress of CSS, Inc. in the U.S. and/or other countries. CSS’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names or email addresses, in connection with any product or service in any manner that is likely to cause confusion

  1. Password:

Keep your password secure. You are fully responsible for all activity, liability and damage resulting from your failure to maintain password confidentiality. You agree to immediately notify CSS of any unauthorized use of your password or any breach of security. You also agree that CSS cannot and will not be liable for any loss or damage arising from your failure to keep your password secure. You agree not to provide your username and password information in combination to any other party other than CSS without CSS’s express written permission.

  1. Registration Information

In consideration of your use of the site, any and all prospective registered users:

  1. Agree to provide accurate, current and complete information as prompted by any registration forms on the Website (“Registration Information”);
  2. Agree to maintain and promptly update the Registration Information, and any other information provided to us, to keep it accurate, current and complete;
  3. Agree to maintain the security of their password and identification;
  4. Agree to be fully responsible for all use of their account and for any actions that take place using their account;
  5. Understand that misrepresentation may preclude use of the Website in the future and/or civil and/or legal action against you;
  6. Understand that CSS does not guarantee any specific results from use of the Website or by Users;
  7. Consent to being contacted by a Website professional for purposes of seeking feedback to ensure and evaluate the quality of its services; and updates on our news and services; and
  8. Ensure that you log out from your account after each use.
  9. Agree not to transfer or sell your CSS account and User ID to another party. You are responsible for all activity of the account and User ID. If you are registering as a business entity, you personally guarantee that you have the authority to bind the entity to this Agreement.
  10. Right to Refuse Service:

CSS’s services are not available to temporarily or indefinitely suspended CSS members. CSS reserves the right, in CSS’s sole discretion, to cancel unconfirmed or inactive accounts. CSS reserves the right to refuse service to anyone, for any reason, at any time.

  1. Fees and Billing

CSS charges a fee for listing an item or services for sale on the site. When you attempt to make a listing on the site, you will have an opportunity to review and accept the fee(s) that you will be charged. CSS at CSS’s sole discretion, may change some or all of CSS’s services and/or fees at any time, with or without notice. In the event that CSS introduces a new service, the fees for that service are effective at the launch of the service.

Unless otherwise stated, all fees are quoted in US Dollars (USD). In certain situations, including but not limited to a void or invalid transaction, CSS may issue a credit for the applicable fees to a user’s billing statement. You are responsible for paying all fees and applicable taxes associated with using CSS. CSS will make best efforts to send a billing receipt to the seller’s email address after making a purchase but makes no guarantee of such. Contact customer support/help should you fail to receive a receipt.

  1. Listings:

By listing on the site, you warrant that you and all aspects of the item or service you offer comply with CSS’s policies. You also warrant that you may legally sell or otherwise transfer ownership of the item in your listing, and that said item can be legally sold in your jurisdiction(s) and jurisdiction(s) you are selling to.For listings offering services, you warrant that the services offered in your listings are legal to sell in your jurisdiction(s) and jurisdiction(s) you are selling to. You must accurately describe your item or services in your CSS listing. Your listings may only include text descriptions, graphics, pictures and other content relevant to the listing.CSS has the sole right and discretion to remove any listing for any reason which violates any laws, or violates this agreement without liability of any kind, including a refund, to the listing party. CSS shall determine at its sole discretion, and may change with or without prior notice to the public, how long a user listing may be published on the site for.

As part of a transaction, you may obtain personal information, including email address, home or business shipping information, and/or phone numbers from another CSS user. Without obtaining prior permission from the other user, this personal information shall only be used for that transaction or for CSS related communications. CSS has not granted you a license to use the information for unsolicited commercial messages. Without limiting the foregoing, without express consent from the user, you are not licensed to add any CSS user to your email or physical mail list. .

CSS does not control the Content provided by users that is made available on CSS. You may find some Content to be offensive, harmful, inaccurate, or deceptive. There are also risks of dealing with underage persons or people acting under false pretense. Additionally, there may also be risks dealing with international trade and foreign nationals. By using CSS, you agree to accept such risks and that CSS (and CSS’s officers, directors, agents, subsidiaries, holding company, parent company, joint ventures and employees) is not responsible for any and all acts or omissions of users on CSS. CSS has the sole right and discretion to change how long a listing shall be published on the site, with or without notice.

Please use caution, common sense, and practice safe buying and selling when using CSS. Users are solely responsible for interactions with other Users. Users must comply with CSS’s policies and acknowledge and agree to comply with the laws of the city, county and country in which the Meeting occurs. CSS can not, will not, and does not supervise or control any user-initiated online or offline gatherings, meetings or the interactions among and between users and other persons or companies. Users are solely responsible for interactions with others. Users understand that CSS does not in any way screen its users. All users agree to exercise caution and good judgment in all interactions with others, particularly if meeting offline or in person.

In the event a dispute arises between you and another user or a third party, CSS encourages you to contact the user or third party to resolve the dispute amicably. If a buyer and seller are unable to resolve a dispute resulting from a transaction that occurs on CSS, CSS will not make judgments regarding legal issues or claims and disclaims any liability concerning the transactional dispute. You release CSS (and CSS’s officers, directors, holding companies, parent company, agents, subsidiaries, joint ventures and employees) from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with disputes with one or more users, or an outside party.

  1. User Content & Warranties.

CSS does not claim any ownership rights in any text, works of authorship, images, photos, video, files, documents, applications, or any other materials, including but not limited to content, that you submit to the site for your member profile, listing, or any other area within the site where you have the ability to upload content you own or control. After directly submitting your user generated content to the site for your member profile and/or listing, you continue to retain any ownership rights that you may have in your User Content, subject to the limitations below:

  1. YOU EXPRESSLY REPRESENT AND WARRANT THAT: (i) you own or control the intellectual property rights to your user generated content submitted through the site service for your listing; (ii) the submission of your user content on or through the site does not violate the privacy rights, publicity rights, copyrights, trademarks, contract rights or any other rights of any person or entity. (iii) You agree to pay for any and all royalties, fees, and any other monies owing any person or entity by reason of any User Content submitted by you on or through the Website, and (iv) YOU EXPRESSLY AGREE TO INDEMNIFY CSS, THEIR AGENTS, EMPLOYEES, AND OFFICERS FOR ANY AND ALL CIVIL OR CRIMINAL LIABILITY REGARDING MATERIAL YOU HAVE SUBMITTED WHICH INFRINGES ON INTELLECTUAL PROPERTY RIGHTS OR CONTRACTUAL RIGHTS OWNED BY ANOTHER PARTY.
  2. No portion of your Submissions shall be subject to any obligation of confidence on our part and you should expect no privacy with respect to your Submissions, except for personally identifiable information that is subject to our privacy policy.
  3. You are entirely responsible for all your Submissions for your listing and/or member profile, including without limitation the consequences of posting or publishing them on the Site publicly.
  4. We reserve the right to our sole discretion to decide whether, where, and how a listing is presented/available on the Site. We may refuse to post, deliver, modify or otherwise use or take any action with respect to any submission for a listing and/or member profile. If we have questions about your submitted content for your profile or lisitng, including without limitation, questions regarding copyright and trademark, we may contact you for further information. We may remove listing and profiles for any reason and without any liability to you whatsoever without prior notice.
  5. You may request to remove a member and/or listing profile you created, or to be removed from our database.
  6. CSS may reject, refuse to post, or delete any User Content for any or no reason, including User Content that in the sole judgment of CSS violates this Agreement or which may be offensive, illegal or violates the rights of any person or entity, or harm or threaten the safety of any person or entity. CSS assumes no responsibility for monitoring the Website for inappropriate User Content or conduct. If at any time CSS chooses, in its sole discretion, to monitor the Website, CSS nonetheless assumes no responsibility for User Content, no obligation to modify or remove anyinappropriate User Content, and no responsibility for the conduct of the User submitting any such User Content.
  7. You are solely responsible for the User Content that you submit to the Website.
  8. Limitation on Liability

CSS makes no warranties as to the quality, accuracy, safety or legality of any User Content or member and/or professional profile. By your use of the site you agree and acknowledge to be solely responsible for the accuracy, substance and veracity of any User Content for your member listing that you submit or transmit through the Website. CSS cannot, and does not guarantee or promise any specific results from use of the site or service on the site. In no event shall CSS, its directors, officers, employees, agents, suppliers, licensors or third parties connected with the site or site service be liable for any damages, whatsoever, including, but not limited to, any special, incidental, or consequential damages, direct or indirect damages, damages for lost profits, lost business, loss of revenue or loss of use, and any other losses or expenses arising out of or related to any use, whatsoever, of the site, or its service. Notwithstanding any other provision of this Agreement, you expressly agree and understand that our entire liability to you for any cause whatsoever, regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us, for your use of the site service during the term of this Agreement.Further, except in jurisdictions where such provisions are restricted, in no event will we be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from your use of the site or its service, even if we have been advised of the possibility of such damages.

CSS DOES NOT WARRANT THAT THIS WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT DEFECTS IN IT WILL BE CORRECTED OR THAT THIS SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CSS CANNOT AND DOES NOT GUARANTEE OR WARRANT THAT ANY FILES ON THIS SITE WHICH HAVE BEEN DESIGNATED AS AUTHORIZED FOR AND AVAILABLE FOR DOWNLOADING FROM THIS SITE WILL BE FREE OF VIRUSES, TROJAN HORSES, OR OTHER CODE THAT MAY CAUSE DAMAGE OR HARM TO YOUR COMPUTER(S) OR NETWORK(S). CSS FURTHER DISCLAIMS ANY RESPONSIBILITY TO ENSURE THAT THE CONTENT LOCATED ON THIS SITE IS NECESSARIY COMPLETE AND UP-TO-DATE. YOU ACKNOWLEDGE THAT THE CONTENT ON THIS SITE MAY INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS, AND CSS MAY MAKE CHANGES OR IMPROVEMENTS AT ANY TIME. –

  1. Limited License to Access and use the site for personal use.

Except for your own User Content on the site, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited. Such license is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the Website or the Site Content otherthan as specifically authorized herein, without the prior written permission of CSS, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.
  4. Prohibited content & activity.

The following are examples of the kind of user content that is illegal or prohibited to submit to the site. We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, removing the offending content from the Website and terminating the Membership of such violators. Prohibited Content includes, but is not limited to, content that, in the sole discretion of CSS:

  1. Is patently offensive and promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
  2. harasses or advocates harassment of another person;
  3. exploits people in a sexual or violent manner;
  4. contains nudity, excessive violence, or offensive subject matter or contains a link to an adult website;
  5. solicits personal information from anyone under 18;
  6. publicly posts information that poses or creates a privacy or security risk to any person;
  7. constitutes or promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
  8. constitutes or promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacturer-installed copy-protect devices, or providing pirated Images or links to pirated Images files;
  9. involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”;
  10. contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
  11. Furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;

  13. involves commercial activities and/or sales without prior written consent from CSS such as contests, sweepstakes, barter, advertising, or pyramid schemes;
  14. includes a photograph or video of another person that you have posted without that person’s consent;
  15. violates the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other rights of any person or party.

The following are examples of the kind of activity that is illegal or prohibited on the site. We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities. Prohibited activity includes, but is not limited to:

  1. criminal or tortuous activity, including child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;
  2. listing, advertising to, or solicitation of, any Member to buy or sell any products or services through the unauthorized or impermissible use of the Website, including without limitation, the listing of counterfeit goods; for sale,

or the sale/listing of any items that have been identified by the U.S. Consumer Products Safety Commission (CPSC) as hazardous to consumers and therefore subject to a recall;

  1. circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person in circumventing or modifying any security technology or software that is part of the Website;
  2. activity that involves the use of viruses, bots, worms, or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware, or otherwise permit the unauthorized use of or access to a computer or a computer network;
  3. covering or obscuring the banner advertisements on any Website page via HTML/CSS or any other means;
  4. any automated use of the system, such as, but not limited to, using scripts to submit information or send comments or messages;
  5. interfering with, disrupting, or creating an undue burden on the Website or the networks or services connected to the Website;
  6. impersonating or attempting to impersonate another Member, person or entity;
  7. using the account, username, or password of another Member at any time or disclosing your password to any third party or permitting any third party to access your account; using any information obtained from the Website in order to harass, abuse, or harm another person or entity, or attempting to do the same;
  8. accepting payment or anything of value from a third person in exchange for your performing any commercial activity through the unauthorized or impermissible use of the Website on behalf of that person;

or

  1. using the Website in a manner inconsistent with any and all applicable laws and regulations.
